Legge Farrow represented
various Underwriters at Lloyd’s London in securing a landmark decision from the
Texas Supreme Court in Gilbert Tex. Constr. Co. v. Underwriters at Lloyd’s
London, issued on December 17, 2010. This insurance coverage matter arose
out of construction dispute involving the Dallas Area Rapid Transit (DART)
system and involved claims in excess of $25 million. Despite the amicus curiae
support that was filed in support of Gilbert Texas Construction Co., the Texas
Supreme Court ruled in favor of Underwriters at Lloyd’s London that provided
$100 million in coverage for the DART project. The National Insurance Law Forum
listed the Gilbert opinion as one of the “most influential opinions of
2010.” Legge Farrow attorneys Glenn Legge and Karen Conticello represented
Underwriters through the trial court, the appellate court and the Texas Supreme

Legge, participated in the 2010 Advanced Contract Risk Management Conference for
Oil and Gas. Mr. Legge’s presentation was entitled “Contractual Indemnity,
Warranty and Additional Insured Provisions – Yours, Mine and Ours”and
was directed at the contractual risk allocation issues that are faced by both
operators and contractors in the onshore and offshore exploration and production

Legge Farrow partner Glenn Legge appeared before the Texas Supreme Court for the
second time in 11 months, in the matter of TheHouston Exploration
Company v. Wellington Underwriting Agencies Limited, et. Al. Mr. Legge
represented various Underwriters at Lloyd’s London in this insurance coverage
matter which arose out of an offshore construction dispute. The insurance
coverage at issue was provided by a Welcar 2001 builder’s risk policy, which is
used in major construction projects throughout the world. This matter is the
first time that a state or federal court in the United States has interpreted
the Welcar 2001 policy wording. The Texas Supreme Court has not yet issued its

associate Paxton Crew recently delivered a presentation on Voyage
Data Recorders and Marine Casualty Investigations at the Fleet
Senior Officers’ Conference of a major U.S. tanker operator.
The firm has experienced increased involvement of VDR data in its
civil litigation practice, as well as in its representation of firm
clients in U.S. Coast Guard Marine Casualty investigations.

partner Jim Brown recently spoke at the American Pilots’ Association
Biennial Convention in Las Vegas. The topic of his
presentation was protecting the rights of vessel owners, mariners,
and other Parties-in-Interest in U.S. Cost Guard investigations.
Mr. Brown also provided updates on ongoing Legge Farrow efforts to
enforce favorable Coast Guard policy letters issued as a result of
previous Legge Farrow appeals of Coast Guard actions. For our

The Southeastern
Admiralty Law Institute has appointed Paxton Crew as port director
at-large for the State of Texas. He will serve a 2 year term
beginning January 1, 2011.
